A suspended repossession order is an arrangement put in place by a county court judge to allow people to remain in the property whilst maintaining payments agreed by all parties. In certain circumstances an arrangement can be made when no payments are made, such as the sale of a property is to take in a specified timescale.
These are rare and need to be legally ratified so as not be allow costs to incurred when there is no sale taking place, the clients solicitor would need to confirm that the conveyancing process is taking place and that legal exchange will take place within a predetermined period.
In some circumstances the suspended repossession order can be changed when circumstances change and the agreement varied to allow the client to pay less. We have known some clients having to pay £500 extra per week to reduce the arrears, after our intervention this was reduced to £200 per month.
The biggest problem here was the fact the client was bullied by the lender into paying something they couldn't afford because they weren't aware of their own rights, this wasn't ratified by the courts.
We have also been successful in obtaining up to five consecutive suspensions, very difficult but there was unique circumstances involved but without professional help it would be unlikely that this could have been achieved.
